Whirlwind 11 Breeding Contract:2008

To the Stallion Whirlwind 11   CWHBA registered & licensed AB- [CAN}03S for the sum of $1500.00 Canadian dollars plus GST (for Canadian transactions).

Payment to be made of: $250.00 non-refundable booking fee . Payable to MJ Farms, prior to the mare arriving at MJ Farms, or to commit to a limited number of public breeding. The remainder of $1250.00 Canadian dollars (plus GST on Canadian transactions) must be paid in full before a first cover is made or semen is shipped.

LIVE FOAL GUARENTEE:

For the owner to obtain rebreeding privileges: the owner agrees to produce a veterinary certification of proper Rhinopneuminitis vaccinations during the 5^th, 7th,and 9^th month of pregnancy.  A veterinary certification - as to the cause of abortion or death of foal. Return service is limited to two cycles in the following year on the mare in this contract. (If there is a need to substitute the mare, prior agreement must be obtained from the syndicate managers)  Null and void on stallions’ death. There will be no more than 5 cycles total to complete the live foal provision of this contract. (3 in the year of contract) 2 the following year if above conditions are met. This will forfill the agreed upon live foal guarantee provision of this contract. There will be no live foal guarantee for mare testing with less than a grade 2 biopsy.

SHIPPED LIVE CHILLED SEMEN:

All costs of transporting the semen beyond the town of Olds will be borne by the mare owner. The mare owner will also return the shipping container at their cost within 2 days of receipt by the fastest method possible. (Bus, courier). If the container is not back to MJ Farms within 6 days of shipping out of semen, the mare owner may be charged a surcharge of $250.00. All mare veterinarian costs will be borne by the mare owner. In the event of a mare not conceiving in two cycles the management team may request a biopsy of uterine condition to be the mare owner's expense.

MARE CARE FOR ON SITE INSEMINATION:

The mare owner agrees to pay to MJ farms: $______/day plus GST: mare care per day.  A payment of 30 days of mare care must be prepaid on mare's arrival. If the mare stay is under 30 days the excess will be refunded at the time of the mare leaving MJ Farms. All costs of mare care past 30 days and professional fees are due and payable on billing, and must be paid in full prior to the mare leaving MJ Farms.

 MJ Farms agrees to use industry standard management practice in shipping of semen, and mare management for breeding. In the event of an emergency MJ Farms will make all reasonable efforts to contact the owner, however when the owner is not available in a reasonable time MJ Farms will contact the proper professionals to care for the horse.

 The Mare owner agrees to hold MJ Farms: it’s staff and managers blameless in the event of accident, illness or death of the above mare and or foal providing standard care has been taken.
